Any person who makes application for appointment for Chief Magistrate, shall first submit to a criminal background check. No person
convicted of a felony or any misdemeanor crime set forth in articles eight, eight-a, eight-b, eight-c
or eight-d, Chapter sixty-one of the West
Virginia code is eligible to become Chief Magistrate.
This is an exempt-
professional position
with the Chief Magistrate working for and at the direction of the
City Manager.
Chief Magistrate must
attend and complete any
required instruction if not admitted to practice law in this state and must
attend annual continuing education if required.
Applicants must possess knowledge of: West
Virginia Rules of! Criminal Procedures for Magistrate Courts, West Virginia Stat! e Code, Codified
Ordinances of the City of Martinsburg and
applicable case law and court procedures
and operations.
The Chief Magistrate is responsible for presiding over arraignments and pleas for misdemeanor and civil traffic cases filed with the Martinsburg
Municipal Court. The Chief Magistrate is responsible for applying relevant Supreme Court Rules, state statutes, City ordinances and case law when presiding over
arraignments and pleas and may, from time to time, preside at trials to the court, pre-trial conferences, motions, reviews and signs complaints,
issue warrants that merit probable cause for arrest and other hearings. Chief Magistrate is also responsible for imposing sentences commensurate to the offense within parameters allowed by law.
The Chief Magistrate determines conditions, which, if met, will allow the defendant's release from police custody.
The Chief Magistrate will also ! supervise the activities of the magistrates, municipal court clerks and municipal court cashier. Chief Magistrate will plan and carry out policies
related to administrative, fiscal and clerical functions. This position is also responsible for establishing workload and assignments and reviewing the work of subordinates. Chief Magistrate is responsible for departmental budgets and
expenditures and conformance. This includes
accuracy of departmental accounting such as
posting to ledgers and balancing of revenue.
Strong customer service skill is required and
communication must be professional and ethical. Defendants rights and/or any sentence must be communicated in a manner that is clearly understandable.
Salary of $32,586
with City benefits.
