In addition to being responsible for all personal injury and third party claims that arise on a territory, supervises at least one Manager Field Investigations (MFI). Investigate all aspects of an incident, and relying on a variety of legal issues must evaluate causation, financial exposure to company, medical treatment and possible vocational rehabilitation. Decides the estimated value for financial reserves, and devises a plan for resolving (settling or litigating) the issue. Must implement plan individually or as part of a team. Responsible for Performance Management process for at least one MFI.

Primary Activities and Responsibilities:
Work with injured employees to maximize their rehabilitation and work opportunities.

Investigate all events that arise from operation of the railroad and other entities on an assigned territory.

Uses experience gained to support strong culture of safety with respect to the public and employees.

Negotiates and makes recommendations for complex claim settlements and lawsuits.

Works closely with attorneys and experts in preparing complex cases for trial and attends trials. Coordinates third party claim management, including subrogation and other matters.

Works closely with local operating and public affairs teams, and participates actively in safety committee and public safety efforts.

Responsible for training and managing at least one MFI, including establishing goals and Performance Management.

Miscellaneous activities and responsibilities as assigned by manager.

Qualifications

Minimum Qualifications:
Bachelors degree from an accredited institution required

3 or more years of experience required in Transportation, Logistics, Rail Operations, Occupational Claim Handling, Legal, or related field

Certifications: Advanced Association of American Railroads (AAR) Claims School

Preferred Qualifications

In addition to meeting the above qualifications, any of the following are preferred:

Bachelors degree from an accredited institution in Business, Criminology, Economics, Finance, Transportation, Logistics, or Rail Operations

Knowledge and Skills:
Knowledge of Risk Management System

Knowledge of Federal Employers Liability Act

Knowledge of Locomotive Inspection Act

Knowledge of Safety Appliance Act

Knowledge of Code of Federal Regulations regarding Railroad Safety

Knowledge of Railroad Retirement Board disability process

Knowledge of Off Track Vehicle Benefit Plan

Photography skills

Microsoft Outlook skills

Ability to communicate effectively on all aspects of railroad operations

Job Requirements:
Work hours may vary in length and schedule (may include a non-standard workweek)

Basic hours are 8 - 5 Monday to Friday, but must be available to respond when an accident occurs.

Wear protective equipment such as hard hat, hearing protection, steel-toe boots, safety vest, and safety glasses

Need to be available to report to work with two-hour advance notice.

Work hours include

rotating

on-call responsibilities which may be on weekends or outside standard work hours

On call 24/7 and must respond to accidents involving evacuations, injuries or deaths.

The applicant selected for this position may be required to successfully complete a background check and physical including a drug test. Passing results must be received prior to start date in new position.
